Apple’s iTunes is a leading online store in the music industry, and is enjoyed and used by many. However, some do not like Apple and their products, most notably the iPod, and feel that the way their iTunes music can only be played on iPods makes it monopolistic.

This lawsuit was filed by Frederick Black who is a resident in Florida and it has reached the US District Court for the Southern District of California.  Frederick Black also feels that the lack of Microsoft’s Windows Media support on the iPod limits the competition.

“[Apple], by controlling such a large part of the portable digital media player market, the online music market and the online video market, maintains sufficient economic power in these markets to control consumer pricing in these markets, which has resulted in consumers paying higher prices,” says Black.

The main reasons as to why Apple may be in trouble are:

• Florida Deceptive and Unfair Trade Practice Act,
• Attempted monopolization in violation of the Florida Antitrust Act
• Monopolization in violation of the Florida Antitrust Act

If Frederick Black wins this case,  he will make approximately $15,000 along with possible attorney fees.
